Terms of Service 服務條款
Welcome. These terms govern your use of the Smoky mobile app and smoky.calenzy.com (collectively, the "Service"), operated by Calenzy Pte. Ltd., a development agency based in Singapore with a team in Taipei ("Smoky", "we"). By using the Service you agree to these terms. If you don't agree, please don't use the Service.
1. Who can use Smoky
You must be of legal smoking age in your jurisdiction (18+ in Taiwan). Smoky does not encourage anyone, particularly minors or non-smokers, to start smoking. The Service exists to reduce friction for adults who already smoke and want to do so legally and considerately.
2. What Smoky is, and what it isn't
Smoky displays the locations of designated and permitted smoking areas as best as we can determine them, based on public data, fieldwork, and user submissions. Smoky is informational only. Local laws change, signs go up and come down, private property rules vary. You are solely responsible for confirming that smoking is legal and permitted at any specific location before you light up. We do our best, but we cannot guarantee that every spot is currently legal, open, or accurate.
3. Acceptable use
You agree not to:
- Submit false, malicious, or copyrighted content to the spot database.
- Scrape, mirror, or resell Smoky's spot data without our written permission.
- Use the Service to harass, dox, or endanger anyone.
- Use Smoky to violate local laws.
4. User submissions
When you submit a smoking-area suggestion, photo, or correction, you grant Smoky a worldwide, royalty-free license to display, edit, and distribute that submission as part of the Service. You confirm you have the right to share it. We may reject or remove any submission at our discretion.
5. Health & disclaimers
Smoking harms your health. The existence of this app is not an endorsement of smoking. If you'd like to quit, please consult your doctor or your local public-health authority (in Taiwan: hpa.gov.tw). Smoky provides location information only and makes no claim about the health, safety, or legality of any specific location or activity.
6. The Service is provided "as is"
Smoky is provided on an "as is" and "as available" basis, without warranties of any kind. To the maximum extent permitted by law, Calenzy is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to fines, citations, injuries, or property loss.
7. Pricing
Smoky is currently free to use. If we ever introduce paid features, you'll be told clearly before being charged. We will not retroactively charge for previously-free features.
8. Termination
You can stop using Smoky any time by deleting the app. We may suspend access for anyone who violates these terms or abuses the Service.
9. Governing law
These terms are governed by the laws of the Republic of Singapore. Disputes will be resolved in the courts of Singapore, unless mandatory local consumer-protection law provides otherwise.
10. Changes
We may update these terms. Material changes will be flagged in-app and the "last updated" date above will change. Continued use of the Service after updates constitutes acceptance of the new terms.

歡迎使用 Smoky。本條款規範您對 Smoky 行動應用程式及 smoky.calenzy.com（合稱「本服務」）之使用，由總部位於新加坡、團隊在台北的開發機構 Calenzy Pte. Ltd.（以下稱「Smoky」、「我們」）營運。使用本服務即表示您同意本條款；若不同意，請勿使用本服務。
一、使用者資格
您必須年滿所在地區之合法吸菸年齡（台灣為 18 歲以上）。Smoky 並不鼓勵任何人，尤其是未成年人或非吸菸者，開始吸菸。本服務之目的，在於協助既有吸菸者以合法、不打擾他人的方式進行。
二、Smoky 是什麼，不是什麼
Smoky 依據公開資料、實地調查與使用者投稿，盡力呈現指定吸菸區與許可吸菸地點之位置。Smoky 僅提供資訊參考。法規會變動、標示會更新、私人場所亦各有規定。在任何地點點菸前，確認該處合法且允許吸菸，責任在您。我們會盡力，但無法保證每一處資訊皆為最新、開放或正確。
三、合理使用
您同意不從事下列行為：
- 提交虛假、惡意或侵權內容至地點資料庫。
- 未經書面同意，擷取、鏡像或轉售 Smoky 之地點資料。
- 利用本服務騷擾、人肉搜索或危害他人。
- 利用 Smoky 從事違反當地法律之行為。
四、使用者投稿
當您提交吸菸區建議、照片或更正時，即授予 Smoky 全球範圍、免版稅之授權，以利於本服務中展示、編輯及散布該內容。您並承諾擁有分享之合法權利。我們得自行裁量拒絕或移除任何投稿。
五、健康聲明
吸菸有害健康。本 App 之存在並非對吸菸之背書。若您有意戒菸，請諮詢醫師或衛生主管機關（台灣：hpa.gov.tw）。Smoky 僅提供地點資訊，對特定地點或行為之健康、安全、合法性不作任何聲明。
六、服務以「現狀」提供
本服務以「現狀」及「現有」基礎提供，不附帶任何形式之保證。於法律允許之最大範圍內，Calenzy 對因使用本服務所生之間接、附隨或衍生性損害（包括但不限於罰款、傳票、人身傷害或財產損失）不負責任。
七、收費
Smoky 目前免費使用。若日後推出付費功能，將於收費前清楚告知。我們不會就先前免費之功能追溯收費。
八、終止
您可隨時刪除 App 停止使用 Smoky。若使用者違反本條款或濫用本服務，我們得暫停其使用權限。
九、準據法
本條款依新加坡共和國法律解釋與適用。爭議以新加坡法院為管轄法院，但使用者所在地強制性消費者保護法另有規定者，從其規定。
十、變更
我們得更新本條款。重大變更將於 App 內提示，上方「最後更新」日期亦會更動。更新後繼續使用本服務，即視為接受新版條款。
